A KFF analysis of state policies and court decisions, as of April 27, 2026, lists abortion in Arkansas as banned, with a life exemption. State law says a person shall not purposely perform or attempt to perform an abortion except to save the life of a pregnant woman in a medical emergency. Arkansas also has informed consent, ultrasound, and parental consent requirements, set out below. This is general information, not legal advice.

- What the ban says:Arkansas Code 5-61-304, titled Prohibition, says a person shall not purposely perform or attempt to perform an abortion, except to save the life of a pregnant woman in a medical emergency.

- What does not count as a medical emergency:Arkansas law says a medical emergency does not include a condition for which treatment is available that can, in reasonable medical judgment, be expected to preserve or sustain the pregnant woman's life without ending the pregnancy; a psychological or emotional condition; or a medical diagnosis that is based on a claim made by the pregnant woman or on a presumption that she will engage in conduct that could result in her death or cause substantial and irreversible physical impairment of a major bodily function.
- Where an abortion may be performed:An abortion permitted under Arkansas Code 5-61-304 or 5-61-404 shall not be performed or attempted unless it takes place in a hospital or an emergency room.
- Contraception is not covered:Subsection (c) of Arkansas Code 5-61-304 lists things that the section does not do. One of them is that the section does not prohibit the sale, use, prescription or administration of a contraceptive measure, drug or chemical, if the contraceptive measure, drug or chemical is administered before the time when a pregnancy could be determined through conventional medical testing and if it is sold, used, prescribed or administered in accordance with manufacturer instructions.
- Penalty:Arkansas Code 5-61-304 is titled Prohibition. It says a person shall not purposely perform or attempt to perform an abortion except to save the life of a pregnant woman in a medical emergency. It also says that performing or attempting to perform an abortion is an unclassified felony, with a fine not to exceed one hundred thousand dollars, or imprisonment not to exceed ten years, or both.
- How the ban took effect:The act that carries this prohibition says it becomes effective on and after the certification of the Attorney General that the United States Supreme Court overrules, in whole or in part, the central holding of Roe v. Wade, thereby restoring to the State of Arkansas the authority to prohibit abortion, or that an amendment to the United States Constitution is adopted that, in whole or in part, restores that authority.
- Waiting period and in-person information:Health has made the printed materials available at the time that the 24 physician or the physician's agent is required to inform the woman of her 25 right to review them. 26 27 SECTION 7. Arkansas Code § 20-16-1703(b)(1) and (2), concerning the 28 informed consent requirement under the Woman's Right-to-Know Act, are amended 29 to read as follows: 30 (1) At least forty-eight (48) seventy-two (72) hours before the 31 abortion, the physician who is to perform the abortion or the referring 32 physician has informed the woman, orally and in person, of the following: 33 (A) The name of the physician who will perform the 34 abortion; 35 (B) Medically accurate information that a reaso
- If there is a medical emergency:Act 801 of the 2019 regular session, approved on April 9, 2019, amended Arkansas Code 20-16-1706 on medical emergencies. Under that section, when a medical emergency compels the performance of an abortion, the physician shall inform the woman before the abortion, if possible, of the medical indications supporting the physician's judgment that an immediate abortion is necessary to avert her death, or that a seventy-two hour delay will cause substantial and irreversible impairment of a major bodily function.
- Ultrasound before consent:Act 498 of the 2021 regular session, approved on March 29, 2021, amended Arkansas Code 20-16-602 and created the Right-to-Know-and-See Act. Under that section, before a pregnant woman gives informed consent to an abortion, or is administered any anesthesia or medication in preparation of an abortion, the physician or qualified technician shall perform an obstetric ultrasound on the pregnant woman using a method that the physician and the pregnant woman agree is best under the circumstances, provide a simultaneous verbal explanation of what the ultrasound is depicting, and display the ultrasound images so that the pregnant woman may view them. The same section says it does not apply in the case of a medical emergency, and that it does not prevent a pregnant woman from averting her eyes or looking away from the ultrasound images.

- If you are under 18: what the court process covers:If a pregnant minor does not wish to obtain the consent of one or both parents, or of a guardian or custodian, she may petition a circuit court for a waiver of the consent requirement, and she may participate in the proceedings on her own behalf. The court shall advise her that she has a right to a court-appointed counsel and, upon her request, shall provide her with such counsel. These requirements and procedures are available to a pregnant woman regardless of whether she is a resident of the state.
